Terms of Service

Last updated: September 16, 2026

1. Who we are

BingDrop is a campus pickup-delivery platform operated by BingDash ("BingDash," "we," "us," or "our"), an independently operated business not affiliated with, endorsed by, or sponsored by Binghamton University. By creating an account or using BingDrop, you agree to these Terms of Service ("Terms"). If you don't agree, don't use the service.

2. Who can use BingDrop

BingDrop is built for the Binghamton University student community. To use it you must be at least 18 years old and able to enter a binding contract. We may ask you to verify your affiliation with the university and may refuse or terminate service to anyone at our discretion.

3. What BingDrop is — and isn't

BingDrop does not sell, prepare, or take orders on behalf of any restaurant or merchant. You place and pay for your order directly with the merchant (for example, through Grubhub or in person) using your own payment method. BingDrop's service is limited to arranging for a courier to pick up an order you've already purchased and deliver it to a campus meeting location you choose.

Because BingDrop has no control over how a merchant prepares, packages, or labels food, we are not responsible for food quality, safety, allergens, or accuracy of a merchant's order. Any issue with the food itself is between you and the merchant.

4. Fees and payment

Delivery fees are shown to you before you pay and are charged through our payment processor, Stripe. You may add an optional tip, which goes entirely to your courier. BingDrop does not store your card details — Stripe handles all payment processing.

5. Delivery windows and estimates

Any pickup time, delivery time, or courier arrival estimate shown in the app is an estimate only, not a guarantee. Delivery times can be affected by courier availability, merchant prep time, weather, and campus conditions.

If no courier accepts your delivery within the dispatch window, it will automatically be cancelled and refunded in full — you don't need to contact support for this specific case, though you're welcome to.

6. Cancellations and refunds

You may cancel a delivery before a courier accepts it. Once a courier has accepted and is en route, cancellation may not be available or may not be eligible for a refund, since the courier has already committed time and, in some cases, purchased or picked up your order. If something goes wrong with your delivery, contact support and we'll review it.

7. Couriers are independent contractors

Couriers who accept and complete deliveries through BingDrop are independent contractors, not employees, agents, or representatives of BingDash. Couriers set their own availability, choose which deliveries to accept, use their own transportation, and are solely responsible for their own taxes and compliance with applicable law. BingDash does not direct or control how a courier performs a delivery beyond the basic mechanics of the platform (pickup confirmation, PIN handoff, etc.).

Couriers are paid via a BingDrop wallet funded by completed deliveries and can cash out to their bank account through Stripe once their balance reaches the platform's minimum cash-out threshold.

8. Account conduct

You agree not to:

  • Provide false information about an order, delivery, or your identity.
  • Use BingDrop for anything illegal, fraudulent, or abusive.
  • Harass, threaten, or endanger another user, including couriers and customers.
  • Attempt to circumvent, disable, or interfere with the platform's security, rate limiting, or fraud-prevention systems.
  • Misuse the PIN handoff or ratings system to defraud another user.

We may suspend or terminate any account, at any time, for violating these Terms or for conduct we reasonably believe is harmful to other users or the platform.

9. Disputes between users

BingDrop provides a support channel (in-app and at bingdash101@gmail.com) to help resolve issues between customers and couriers, including missing orders, wrong orders, or courier no-shows. We'll do our best to make it right, but we are not a party to the underlying transaction between you and a merchant, and our liability is limited as described below.

10. Limitation of liability

To the maximum extent permitted by law, BingDash's total liability to you for any claim arising from your use of BingDrop is limited to the amount of fees you paid to BingDrop for the delivery giving rise to the claim. BingDash is not liable for indirect, incidental, or consequential damages, or for the acts or omissions of merchants or couriers, who are independent third parties.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above. Continuing to use BingDrop after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. If a dispute arises, we ask that you first contact us at bingdash101@gmail.com so we can try to resolve it informally. Any dispute that can't be resolved informally will be handled in the state or federal courts located in New York.
